Throughout these Terms, “Fackt,” “we,” “us,” and “our” refer to Fackt s.r.o. “Client,” “you,” and “your” refer to any person or business using our website or purchasing our services.
Acceptance of Terms
By using our website, booking a call, requesting a quote, accepting a proposal, or making a payment, you agree to these Terms, our Privacy Policy, and our Refund Policy.
If you are acting for a company or other entity, you confirm that you have authority to bind that entity.
Contract Formation
A binding agreement is formed when:
you accept our proposal or written offer;
you confirm by email or message that you want to proceed; or
you pay a deposit, invoice, or retainer fee.
Submitting an inquiry or booking a discovery call does not by itself create a binding contract.
Fees and Payments
Pricing, payment terms, and billing structure are set out in the relevant proposal, invoice, or written agreement.
Unless stated otherwise:
payment may be required in advance or as a deposit before work begins;
work may be paused if payment is late;
final files, transfer of rights, or delivery may be withheld until full payment is received;
fees do not include third-party costs unless clearly stated.
Revisions
We aim to deliver work that matches the agreed brief and direction.
Where revisions are included, we will make reasonable revisions to align the work with what was agreed. Revisions do not include entirely new concepts, major changes in direction, or additional work outside the agreed project.
If there is an issue with the work, we must first be given a fair opportunity to correct it before any refund claim is considered.
Client Responsibilities
You agree to:
provide accurate information and timely feedback;
supply content, materials, approvals, and access needed for the project;
ensure that anything you provide to us is lawful and does not infringe third-party rights;
communicate clearly and in good faith throughout the project.
We are not responsible for delays caused by missing information, late feedback, or changes in instructions.
Intellectual Property
All rights to final deliverables transfer to the client only after full payment has been made.
Fackt retains ownership of:
pre-existing tools, methods, templates, systems, and know-how;
unused concepts, drafts, and rejected work;
third-party elements subject to separate licenses.
You retain ownership of materials you provide to us, but you give us permission to use them as needed to perform the services.
Portfolio Rights
Unless otherwise agreed in writing, we may display completed work in our portfolio, on social media, or in case studies for promotional purposes.
If the project is confidential or covered by NDA, we will respect that written agreement.
Liability Disclaimer
We provide services with reasonable professional care and skill. However, we do not guarantee specific business results, including conversions, revenue, traffic, approvals, rankings, or platform acceptance.
To the fullest extent permitted by law, Fackt is not liable for indirect or consequential losses, including lost profits, lost business, or lost opportunities.
Our total liability for any claim relating to a project is limited to the amount paid by you for that specific project.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
Refunds and Consumer Rights
Refunds are governed by our Refund Policy.
If you are a consumer, you may also have statutory rights under applicable law, including withdrawal rights in some cases. Nothing in these Terms limits any rights that cannot legally be waived.
Governing Law and Disputes
These Terms are governed by the laws of the Slovak Republic.
Any dispute will be handled by the competent courts of Slovakia, unless mandatory consumer protection law provides otherwise.
If you are a consumer and have a complaint, you may also be entitled to use an alternative dispute resolution body where applicable.

How long does a typical project take to complete?
I follow a clear project structure that keeps things moving. Simple projects usually take 2-3 weeks, while full product designs can take 1-2 months. After our initial consultation, l'll give you a detailed timeline so you always know what's happening next.

Can you work with my existing brand and designs?
Absolutely. We audit what you have, keep what’s working, and refine what isn’t. We can extend your current system (Figma/Framer/Webflow, etc.), or modernize it without losing brand equity—then hand off clean, editable source files.

What makes your design process unique?
Conversion-first UX meets premium visual design and motion. You get early clickable prototypes, tight feedback loops, and transparent milestones—resulting in pixel-perfect, fast, and accessible experiences that look great and perform.

Do you offer ongoing support after the project is completed?
Yes. Choose a monthly growth plan (updates, new sections/pages, A/B tests, performance/SEO checks, monitoring) or ad-hoc support as needed. We stay available for tweaks, iterations, and future launches.

How do you handle confidentiality and intellectual property rights?
We’re happy to sign an NDA and use secure workflows. Upon final payment, you own the deliverables—designs, code, and editable files. Any third-party assets are correctly licensed to your organization.
